The index, the claim, and the sale.
Last updated 15 October 2026
These terms apply to emmi.socii.au, the business studio, and any order placed with Buy on EMMI. They are the agreement between you and SOCii, the operator of the Ethical Merchant & Maker Index. The Privacy policy explains what information we keep.
The index
EMMI is a public guide to Australian makers, merchants, manufacturers, suppliers, and repairers. A listing describes what we have been able to document. It is not a promise that every fact is complete, current, or endorsed.
Unknown evidence stays unknown. It is not a negative judgement. A practice such as Australian-made is shown on a product only when that product record states it. A shop can be local and still sell something made elsewhere.
Some purchases are completed on the maker’s own website. Those sales are between you and the maker, on the maker’s terms. Buy on EMMI is the separate checkout described below.
Your account
Public sign-in is Persona by SOCii. You must give accurate account details and keep access to that email address. You are responsible for activity under your account.
A business login is a separate organisation account. It is created only after a claim is approved, and it belongs to that claimed business. One approved claim has one organisation. Creating an organisation does not create a new listing.
Claiming a business
“This is my business” is available on a listing that already has an ABN and the ABN holder’s legal name. By starting a claim you confirm that you are entitled to represent that holder.
You must complete the photo-ID check. Stripe collects the document. We compare it with the ABN holder and then delete it, as described in the Privacy policy. An email address on the business’s own web domain can approve a natural person’s claim immediately. A company, trust, or association is reviewed by a person.
We may refuse, pause, or reverse a claim that we cannot verify, that conflicts with another claim, or that misstates who operates the business. Approval lets the organisation edit the public page, add market and event appearances, list products, and request payouts. It does not transfer ownership of the EMMI index.
What a claimed business may publish
You are responsible for the description, prices, availability, market dates, and product claims you add. Do not state a certification, origin, or capability the business cannot support. Do not publish someone else’s personal information.
The ABN and legal name remain the register facts on the listing. Research updates will not overwrite the fields you manage, and will not remove a product that is sold through EMMI checkout.
Buying on EMMI
Buy on EMMI is available only on products the business has marked for checkout. You pay in Australian dollars through Stripe. EMMI takes the payment and pays the maker the balance after the fee below. The maker supplies the goods or services, including making, packing, and delivery.
The price shown is the price charged, unless a promotion we have actually attached to that checkout reduces it. A code created only inside the maker’s own Stripe dashboard does not apply to an EMMI checkout.
Fees
There is no membership or subscription fee to be listed or to claim a business.
On a Buy on EMMI sale, the fee is a 1.5% commission plus an estimate of domestic Australian card processing of 1.7% plus 30 cents. That fee is deducted from the payment before the maker is paid. International cards can cost more to process. EMMI absorbs that difference rather than adding it to the maker’s fee.
Refunds and the Australian Consumer Law
Nothing in these terms excludes, restricts, or modifies the Australian Consumer Law, or any other right that cannot legally be excluded.
The maker is responsible for repair, replacement, or refund where the consumer guarantees require it, and for the delivery promise published with the product. If you have a problem with an EMMI order, contact the maker. If you cannot resolve it, write to us at privacy@socii.au with the order details and we will help you reach them.
A refund of an EMMI payment is returned to the original payment method.
Acceptable use
You must not:
- claim a business you are not entitled to represent
- use a photo identity document that is not yours
- scrape the index in a way that degrades the service, or republish it as your own directory
- interfere with checkout, sign-in, or another person’s account
- post a review that threatens a person, publishes their private contact details, or pretends to be a verified purchase when it is not
Intellectual property
EMMI’s name, design, and compilation of the index belong to SOCii or its licensors. A business keeps ownership of the names, photographs, and product text it supplies. You grant us a licence to display that material on EMMI for as long as the listing or product remains published.
Public map data is used under the licences of its providers, including OpenStreetMap contributors.
Liability
The index is a research and discovery tool. To the extent the law allows, SOCii is not liable for a decision you make from a listing, for a sale completed on a maker’s own website, or for a loss that was not a reasonably foreseeable result of our breach.
For a Buy on EMMI order, the maker is responsible for the goods or services. Our responsibility is to operate the checkout, pass on the payment after the stated fee, and not exclude your rights under the Australian Consumer Law.
Suspension
We may suspend a listing, a claim, a product, or an account that breaches these terms, that we cannot verify, or that exposes buyers or other businesses to harm. We will tell the account holder when we can do so without undermining an investigation.
Law and changes
These terms are governed by the laws of Australia. If we change them, we will update the date at the top. The terms in force at the time of an order apply to that order.
